Digest Analysis: The Trying Task of Finding Anti-Corruption Champions

Until 24 June 2015, the KPK Selection Panel (Pansel KPK) have opened registration for Indonesian citizens to participate in candidate selection of KPK leadership. Aside from opening registration, Pansel members are also actively meeting various institutions and communities to gather support, input and advice for the selection process. The purpose of these meetings were to screen candidates of KPK leaders that can live up to public expectations, KPK's needs and challenges going forward, as well as a more effective agenda on corruption eradication.

As of Friday, 12 June 2015, 62 individuals have entered themselves into contention as candidate KPK leader. Pansel noted that among those candidates, 59 were men and the other 3 were women.

The undertaking of Pansel KPK in the current period is not an easy one. Although they are only tasked to choose 8 names among the candidates – two of the required 10 names were already submitted to the parliament, who will select 5 KPK leaders – the current national legal-political situation that do not incline towards the corruption eradication agenda have more or less influenced public enthusiasm of to come forward as candidates.

The main concern here is the public perception that when they serve as a KPK leader, there's a possibility that they would experience the same attack as the one currently suffered by KPK leaders, investigators and anti-corruption movement supporters in general. Surely, it's not a rewarding position to be in, which also spreading an effect of fear. Predictably, many potential candidates who have the competence, skills and integrity to lead the KPK banner have dismissed endorsements to come forward, which is a direct consequence of the risk that would await them should they be elected to occupy the office.

The measures to be taken by Pansel KPK to anticipate waning optimism to participate in the candidacy have become an urgent agenda going forward. Searching aggresively for worthy candidates to participate is a commendable step in this situation. And Pansel KPK have begun to take such measure. They have started to approach a wide range of communities and organizations that have the necessary network, cadres and public figures that could be persuaded to enter the contention.

Concurrent with Pansel's measures, Bambang Widjajanto and Abraham Samad, two non-active KPK leaders was fighting at the stage of Constitutional Court to appeal for clarity from the judges that KPK leaders should not be suspended while on duty just because they were charged in a legal dispute or allegedly involved in a case. Especially when the legal process of the charges are ambiguous and filled with the aroma of non-legal interests. The exception should only be for serious crimes, such as corruption, drug abuse, murder, and red-handed arrests. Meanwhile, the current KPK Law is also considered to be discriminative, since the rules about suspension/deactivation does not apply to other law enforcement leaders, such as the Head of Police or the Attorney General.

The efforts of Pansel KPK and the non-active KPK leadership duo are expected to realign the abnormal law-enforcement situation in the country. Nonetheless, without a direct involvement by President Joko Widodo, the Head of State who have the responsibility to revitalize the current deteriorating legal situation, any measure undertaken by Pansel KPK and the non-active leaders would be futile.
